Critical Analysis of Abuse of Dominant Position with Reference to USA, EU and India - A Comparative Study

This research undertakes a comparative analysis of the abuse of dominant position across the United States, the Euro- pean Union, and India. It begins by outlining the concept of abuse of dominant position and examining its significance within the framework of competition law. The paper subsequently analyses the legal regimes governing abuse of dominant position in each jurisdiction, with reference to relevant statutory provisions and leading judicial precedents. Through a structured comparative approach, it identifies and evaluates similarities and differences in the definition of abuse, enforcement mechanisms, and available remedial measures. The study incorporates selected case studies to demonstrate the practical application of competition law principles, thereby highlighting key insights and interpretative developments. It further assesses the effectiveness of enforcement actions in deterring anti-competitive conduct and in promoting competitive market structures. Ultimately, the research emphasizes the necessity of enhanced international cooperation and regulatory convergence in competition law enforcement to address the challenges arising from abuse of dominant position in an increasingly globalized economic environment.
